“Key Points of Labor Consultation Explained” is a compilation of legal provisions regarding matters including labor contracts and labor conditions as well as the basic legal knowledge that all employees, employers, and residents of the Osaka Prefecture should learn.
Please use it as a reference in your working life.
However, when labor problems actually arise, it is likely that things do not proceed as you hope due to your relationship with the person you are having problems with and intertwined circumstances. About Workplace Harassment

“In regard to workplace harassment, “sexual harassment,” “power harassment,” and “harassment related to matters including pregnancy, childbirth, childcare leave, and family-care leave” are defined by the law as follows.
“Sexual harassment” is defined as a situation in which workers are put at a disadvantage in their working conditions due to their responses to the language or behavior of a sexual nature in the workplace, or a situation in which the working environment of workers is harmed by the language or behavior of a sexual nature.
“Power Harassment,” on the other hand, is defined as acts that meet all of the three following criteria:
(1) language or behavior delivered from a position of power, which (2) exceeds the necessary and reasonable scope of work duties, and is (3) detrimental to the working environment of workers.
Incidentally, appropriate instructions and guidance conducted within necessary and reasonable scope of work duties are not considered power harassment.
Lastly, “Harassment related to matters including pregnancy, childbirth, childcare leave, and family-care leave” is defined as a situation in which the working environment of female workers who have become pregnant or given birth, or male/female workers who have applied for or taken childcare leave or other leaves of absence, is harmed by the language or behavior (related to pregnancy, childbirth, use of childcare leave, etc.) from managers or colleagues in the workplace.
Acts are considered harassment if there is a causal connection between the harassing behavior and the condition of pregnancy, the use of childcare leave, or other leaves of absence.”

About Customer Harassment

Customer harassment is considered to be a situation in which the working environment of the employees is harmed due to extreme nuisance behaviors (physical abuse, threats, extremely abusive language, excessive demands, etc.) from customers and clients.
The “Power Harassment Guideline” set by the Ministry of Health, Labour and Welfare states that “It is desirable for business owners to take initiatives out of consideration for employment management by establishing a consultation system, taking action to care for the victims, as well as creating manuals and implementing trainings to prevent harassment in order to protect the working environment of their employees from being harmed by power harassment or extreme nuisance behaviors from the employees employed by other business owners, such as clients, or business owners themselves.
Customer harassment is categorized into two: cases where demands from customers or other persons or entities lack appropriateness, and cases where methods and manners taken to realize demands are made with socially inappropriate language and behavior.
The guideline requires employers to address unjust demands and complaints that fall into these categories systematically and secure the safety of the employees.

Information on Dispatch of Instructors(Free Dispatch of Instructors for Basic Labor Law/Issue Seminars)

With over 10,000 labor consultations each year, Osaka Prefecture Labor Environment Division (Labor Consultation Center) sends instructors (labor counselors) for free to trainings on labor law and labor issues held by labor unions and small and medium-sized enterprises, so that all workers can work with peace of mind and all employers can manage their workplaces appropriately. Please do not hesitate to make use of this service.

Target1) Labor unions, 2) Small and medium-sized enterprises, 3) Employers’ associations, business communities, trade groups, etc., 4) High schools, universities, vocational schools, etc. (e.g. for teachers), 5) Other institutions whose business objectives are considered appropriate to hold such trainings. *Please inquire to find out if your institution is eligible or not.
